Second U.S. Circuit Court nicks New York’s Concealed Carry Improvement Act

New York can continue to enforce laws banning firearms in certain “sensitive” locations such as public transportation, hospitals and schools, and the state can continue to require that handgun owners be of “good moral character.” (Stock photo)

Three provisions of Gov. Kathy Hochul’s Concealed Carry Improvement Act were struck down earlier this month following a ruling by a three-judge panel of the Second U.S. Circuit Court of Appeals.
On Dec. 8, the Second Circuit panel upheld a district court’s injunctions against the CCIA provision requiring private property owners that allow public access, including businesses, to post signage to allow firearms on their property. Unless successfully appealed, this means property owners will need to post signs if they do not want firearms on their property.
